JUDGMENT B. P. Sinha, J. Heard learned counsel for the petitioner and Mr. Ramji Saran learned counsel appearing for the opposite party. The suit has been filed by the opposite party under section 14 of the Bihar Building (lease, rent, and eviction) Control Act, 1982. An application was flied on behalf of the opposite party under section 15 of the Act for directing the petitioner to deposit the arrears of rent as also the current rent. By the impugned order the trial court has directed the petitioner to deposit the arrears of rent from November, 1984 at the rate of Rs 650/- per month within fifteen days of the order as also the month to month rent by 15th of each succeeding month. Relying upon a decision of this Court in Raghubir Prasad Vs. Surya Narain Gupta Mr. Guru Sharan Sharma Bubmita that in a suit under section 14 of the Act the Court can not direct for depositing arrears of rent. There appears to be substance in this submission. That put of the order dated 13.9.85 directing the petitioner to deposit the arrears of rent is, therefore, set aside. By the impugned order the court below has also directed the petitioner to deposit month to month rent by 15th of the subsequent months. That order shall remain. The petitioner therefore, must deposit the rent at the rate of (Rs 650/- per month from the date of the institution of the suit i.e. for the period from February, 1985 to September, 1985 within fifteen days from today. He also must deposit the current rent beginning from October. 1985 at the same rate by 15th of November, 1985 and go on depositing the same pending disposal of the suit. If the petitioner fails to deposit the above amounts as directed his defence shall be struck off. 2 The trial court is also directed to take necessary steps to dispose of the suit as soon as possible. This application, accordingly succeeds in part in the terms mentioned above. There shall, however, be no order as to costs. Application allowed in part
