JUDGMENT 1. - This petition under section 482 Cr. P.C. has been directed against the order of learned Sessions Judge, Sikar dated 2nd November, 1983, and that of learned Additional Munsif and Judicial Magistrate, Sikar dated 27th May, 1983. 2. Brief facts leading to this petition are that a truck bearing No. DHG 228 was seized by Raghunathgarh Police Station in a case registered under section 395, 397 and 398 Indian Penal Code on FIR No. 4/1983. The truck was seized on 30th January, 1983 at Delhi. The petitioner being the owner of this truck submitted an application before the learned Magistrate on 25th May, 1983. The learned Magistrate vide his order dated 27th May, 1983, dismissed the application filed by the petitioner on the ground that the truck in question was involved in a dacoity. The petitioner aggrieved against the aforesaid order filed a revision but the learned Sessions judge refused to interfere in the order on the ground that no revision was maintainable against an interlocutory order. In these circumstances, the petitioner has filed the present petition under Section 482 Cr. P.C. for giving the delivery of the truck. It is not in dispute that the petitioner is the owner of the truck and it is also registered in his name. No article is to be recovered from the truck now as challan in the case has already been filed. The truck is lying at the Police Station for the last about one year and there is heardly any justification for not giving the custody of the truck to the petitioner. 3. In view of these circumstances this petition is allowed, the order of the courts below are set aside and it is directed that the delivery of the truck No. DHJ 228 will be given to the petitioner provided he furnishes a solvent security in the sum of Rs. 2,00,000/- (Two Lacs) to the satisfaction of the learned Sessions Judge, Sikar before whom the case is now pending, for the production of the truck in the case as and when he is required to do so. On furnishing such security the learned Sessions judge shall give a direction to the concerned Police Station for giving the delivery of the truck to the petitioner. *******
