body1983
JUDGMENT 1. - This petition by the accused-applicants has been filed against the order of learned Judge (C.B.I.), Rajasthan Jaipur dated 12th September, 1983. The grievance of the applicants before the trial court was that they should be supplied with the copies of the charge-sheet, statements recorded under section 161 Cr.P.C. and other documents in Hindi. The contention of the applicants before the trial court was that they do not understand English and the documents filed by the C.B.I. are in English and as such the translation of these documents should be done in Hindi and then the same should be supplied to the applicants. The learned trial court dismissed the application filed by the applicants. 2. It would not be necessary to decide the controversy in the present case as both the parties have agreed that only charge-sheet and the statements recorded under section 161 Cr.P.C. may be translated in Hindi and the same be supplied to the applicants. As regards other documents the applicants have no grievance, if they remain in English. 3. In view of these circumstances, it is directed that the non-applicant shall supply the translated version in Hindi of the charge-sheet and statements recorded under section 161 Cr. P.C. to the applicants. After supplying the aforesaid documents in Hindi, further proceedings would be taken in the case. 4. In order to avoid this difficulty in future, the learned senior Public Prosecutor, for C.B.I., Shri D.R. Jain, informed that steps be taken to record the statements of witnesses in Devnagri script in future so far as Rajasthan is concerned. 5. With these observations the petition is disposed of.Petition disposed accordingly. *******
