JUDGMENT I.B. Singh, Member. - This is a reference dated April 14, 1981 made by learned Commissioner, Jhansi Division, Jhansi, recommending to allow the revision application by setting aside the order dated August 20, 1980 passed by Additional Collector, Jhansi, in a case under Section 198(4) of Act I of 1951. 2. I have heard the learned counsel for the parties and have perused the record. No objection has been filed. 3. I agree with the recommendation of the learned Commissioner, Jhansi Division, Jhansi, as no evidence was recorded on enquiry by the learned Additional collector who based his order only on the report of the Tahsildar, therefore, the revision application is liable to be allowed and the case in liable to be remanded to the Collector for getting it decided according to law after recording the evidence of the parties. 4. In view of the above, the revision application is allowed. The impugned order is set aside an the case is remanded to the court of the Collector for getting it decided afresh as directed above. 5. Let the trial court's file be sent to it as once of necessary action.
