JUDGMENT 1. - Heard learned counsel for the petitioner and the learned Public Prosecutor for the sale after notice to him. 2. Counsel for the petitioner submitted that the petitioner be given the benefit of probation. The petitioner has been convicted of the offence u/s 323 I.P.C, and has been sentenced to three months' simple imprisonment and a fine of Rs. 500/- in default of payment of fine to undergo further three months simple imprisonment. A sum of Rs. 300/- has been awarded to the injured Sayara Bai out of the payment of fine. 3. Having regard to the facts and circumstances, I am inclined to accede to the prayer of the learned counsel for the petitioner. 4. Accordingly the revision petition is partly allowed, conviction of the petitioner is maintained, the sentences and sentence of fine are set aside, The petitioner shall be released on probation provided he furnishes a personal bond in the sum of Rs. 2,000/- together with one surety in the like amount to the satisfaction of the Munsif and Judicial Magistrate, 1st Class, Rajsamand, to appear and receive L sentence during the period of three years and in the meantime to keep peace and be of good behaviourRevision party allowed. *******
