L. v. A. Dikshitulu VS State of A. P.

1984-04-25

AMARENDRA NATH SEN, D.A.DESAI

body1984
ORDER : 1. We heard Mr. P. Govindan Nair, learned counsel for the appellant and Mr. T.V.S.N. Chari, learned counsel for the state of A.P. 2. The dispute between the parties is very narrow. Having heard learned counsel on either side we are satisfied that it is not necessary to go into the details of the computation of benefits claimed by the appellant. Having regard to the facts and circumstances of the case we direct the State of A.P. to give Rs. 50,000/- (Rupees fifty thousand) to the appellant within two months from today in full and final settlement of all the claims of the appellant against the State of A.P. and the High Court of Andhra Pradesh. 3. We would, however, like to clarify one position that the pension payable to the appellant on the date of his superannuation shall be re-computated on the basis of his pensionable salary of Rs. 2075/- per month (deemed to be holding the post of Joint Registrar of the High Court) on the date of his superannuation. This re-computation shall be done within two months from today and the difference between the pension as at present paid and as becomes payable on recomputation shall be paid within two months after the re-computation is done. The fresh pension payment paid shall be made in favour of the appellant. Both the appeals stand disposed of accordingly with no order as to costs.
