JUDGMENT I.B. Singh, M. - This is a revision against order dated 22-2-1980 passed by learned Additional Commissioner, Agra Division, Agra, dismissing revision No. 199 of 1979/Mathura confirming order dated 9-8-1979 passed by learned Additional Collector, Mathura dismissing application of the applicant dated 17-7-1976 for cancelling the Patta of opposite party Nos. 4 to 11 granted on 7-3-1976. 2. I have heard the learned counsel for the parties and have perused the record. 3. It has been rightly argued that the patta of the applicant of the disputed land was not cancelled as yet and the proceeding for cancellation of his Patta is stayed by order dated 20-12-1971 and the proceedings under Rule 115-C was dropped on 16-2-1982, therefore, the subsequent pattas granted to opposite party will not be valid unless the Patta of the applicant is cancelled, therefore the order passed by both the courts below are liable to be set aside and the case is liable to be remanded for fresh decision according to the decision of the cancellation proceeding against the applicant which matter should also be decided by Additional Collector according to law. 4. In view of the above, this revision application is allowed and the case is remanded to the court of learned Additional Collector concerned for fresh decision according to the directions given and cancellation proceeding of the patta of the applicant also should be decided expeditiously. 5. Let all the records of the trial court connected with this revision application and other records summon all be sent at once for necessary action.
