body1984
P. S. POTI, J. ( 1 ) THIS is the proceeding commenced at the instance of one Malde Ghusa who addressed a letter to this Court complaining about the condition of labour in the time quarries at Kajavadari in Porbandar. Thereupon we directed the Labour Commissioner to depute officers to apprise themselves of the situation of the workmen concerned with the work of excavation of time stone and supplying them in public carriers. The Labour Commissioner accordingly made arrangements for the purpose. We received the report from the Labour Officers who visited the area whereupon we Sound that further action was called for. Accordingly we directed issue of notice to the principal employers (1) M/s. Saurashtra Chemicals (ii) Saurashtra Minerals Pvt. Ltd. and (iii) Visamber Minerals Kadia Plot Porbandar and also to the three contractors who have been engaging labour. Instead of dealing with these matters ourselves we thought that it would be advisable in the first instance to assign the matter to the Lok Adalat which met at Porbandar on 2 October 1984 We therefore adopted perhaps the unconventional step of referring this case to the Lok Adalat. ( 2 ) THE matter was taken up by the Lok Adalat on the 2nd October 1984 It is reported that all the managements were present through their representatives and the workmen were also represented by their Labour Unions. The good offices of the Lok Adalat have succeeded in solving the problem raised in the petition and settling the dispute between the workmen and employers including revision of their wages. It is reported to us that the subject-matter of the dispute which had prompted us to take notice of the letter from Malde Ghusa has been settled and therefore no further orders on this petition are called for. ( 3 ) WE record our appreciation of the efforts of all those who participated in the Lok Adalat proceedings to bring about the settlement of this matter out of Court and we also appreciate the services rendered by the Labour Department of the State based upon whose report we took further action in the case. ( 3 ) WE record our appreciation of the efforts of all those who participated in the Lok Adalat proceedings to bring about the settlement of this matter out of Court and we also appreciate the services rendered by the Labour Department of the State based upon whose report we took further action in the case. The matter having been amicably settled between the parties at the Lok Adalat no further orders are necessary in this petition and the petition is closed with liberty to the parties aggrieved by any further development in the same matter to seek to revive the petition and obtain appropriate orders from this Court. No costs. Petition closed. .
