ORDER : 1. After hearing learned counsel for the parties appearing before us, we order that the petitioners or employees represented by them who continue to be governed in fact by the old scheme of payment in respect of pay scales and dearness allowance will be entitled to the payment of the three Addl. D.A. due on 1.8.1983, 1.10.1983 and 1.11.1983, subject to the undertaking given by learned counsel for the petitioners before us on behalf of their respective clients and additionally subject to an undertaking given individually by each employee concerned before such payment that in case such payment results in the employee concerned receiving an excess over the payment to which he would be l entitled in case these petitions fail, such excess will be recovered from him from future payments to which he would be entitled. 2. There will be no orders as to "the interim relief" claimed. 3. Liberty to apply for modification of the order.
