JUDGMENT : 1. Special leave granted. 2. An application, in the proceedings pending before Central Administrative Tribunal, Ahmadabad Bench, was filed by the respondent for summoning of various documents. The Tribunal passed the following order on the application:- "It is directed that as earlier stated half yearly and yearly resumes submitted by the petitioner to the department up to the date of his termination and ACRs of the petitioner up to the date of his termination be kept ready to be shown to the Tribunal and be produced before the learned Advocate for the petitioner and certified copies of the ACRs be also furnished to him, as stated above. Learned Advocate for the respondent states that he would require time if the Tribunal directs the production of the documents as stated above. The learned Advocate for the respondent to produce the documents as stated above before Registrar on 21-12-1988." 3. While issuing notice in the special leave petition this Court had stayed the operation of the impugned order. We have heard Mr. N. N. Goswami, learned Counsel appearing for the appellants. We are of the view that in the facts and circumstances of this case the Tribunal was not justified in directing that the certified copies of the Annual Confidential Reports be given to the respondent. While upholding the other directions given by the Tribunal, we direct that the copies of adverse Annual Confidential Reports be given to the respondent. He would not be entitled to the copies of the other confidential reports which are not adverse to him. We further direct that it is not necessary for the Union of India to produce the original record before the learned Counsel for the respondent or to permit the inspection of all the Annual Confidential Reports. The appeal is disposed of in the above terms. No costs. Order accordingly.
