JUDGMENT B.D. Agarwal, J. - Under an order made by this Court dated February 3, 1983 the application made for impleadment of the subsequent transferees as parties to this appeal was rejected. It was further directed that lower appellate court shall record a finding whether the compromise dated March 5, 1981 and filed in this Court on May 13. 1981 and had been duly arrived at. 2. The lower appellate court has returned the finding dated July 16, 1983. It appears that when the matter was before the lower appellate court there was a fresh application made to which the appellant and the respondent no. 1 are parties wherein they have confirmed that the compromise dated March 5, 1981 was duly arrived at and filed in the court. In view of this application to which the appellant is a party besides the respondent no. 1 there remains nothing to be doubted in regard to the compromise dated March 5, 1981 filed in this Court on May 13, 1981 being duly entered into. The order relating to the rejection of the application for impleadment of the subsequent transferees does not become revisable due to this compromise having been confirmed by the parties. 3. In the circumstances, the appeal shall stand disposed of in terms of the compromise dated March 5, 1981 filed in the Court on May 13, 1981 together with the application dated July 16, 1983. The said compromise shall form part of the decree. Costs on the parties.
