M.C.JAIN

JUDGMENT 1. - Heard the revision petition on merits. 2. The conviction of the petitioner, in my opinion, is unassailable. Both the courts have rightly found him guilty of the offence under Section 323, I.P.C. However, I find it a fit case for probation. 3. The revision petition is partly allowed. The conviction of the petitioner is maintained and instead of sentencing him, it is ordered that the petitioner be released on probation on his furnishing a personal bond for a sum of Rs. 2,000/-(rupees two thousand) with one surety in the like amount to the satisfaction of Munsif and Judicial Magistrate, First Class, Rajsamand, to appear and receive sentence during the period of six months and in the meantime to keep peace and be of good behaviour. 4. One month's time from today is allowed to the petitioner for furnishing the bonds, as prayed by the learned counsel for the petitioner.Revision partly allowed. *******
