JUDGMENT 1. - Heard learned counsel for the petitioner and the Public Prosecutor for the State, after notice to him. 2. Offence under Section 324, I.P.C. it is well proved against the petitioner. The learned counsel for the petitioner urged that the petitioner may be given the benefit of probation. The petitioner is the nephew of the injured Mst. Bawari. 3. Looking to the relations between the parties, I am inclined to extend the benefit of probation to the petitioner. 4. Accordingly, the appeal is partly allowed. The conviction of the appellant is maintained. However, at is ordered that instead of sentencing him he be released on probation on his furnishing a personal bond for a sum of Rs. 1,500/- (rupees one thousands five hundred) with one surety in the like amount to the satisfaction of the Sessions judge, Dungarpur to appear and receive sentence within a period of two and in the meantime to keep peace and be of good behaviour. 5. It is further ordered that the petitioner shall pay a sum of Rs. 250/- (rupees two fifty) by way of Compensation to the injured Mst. Bawari.Appeal partly allowed. *******
