JUDGMENT I. P. Singh, J. - Heard the learned counsel perused the judgments of the courts below. The suit was for the ejectment of the defendant from the house in suit and for the recovery of arrears of rent, damages for use and occupation pedente lite and future damages. 2. The valuation of the suit was Rs. 740/-. The suit being of the nature of Small Cause Courts was actually presented in that court but it was returned under Section 23 of the Small Causes Courts Act for presentation to the proper court i.e., on the regular side. It was accordingly tried by the court below. Ultimately the suit was decreed by the court of Second Additional Civil Judge, Agra. 3. The defendant appellant seeks to file the present IInd appeal. 4. However, I find that second appeal is barred under Section 102 C.P.C. Suit which provides that no second appeal shall lie in any suit of the nature cognisable by Courts of Small Causes where the amount or value of the subject matter of the original suit does not exceed three thousand rupees. There is no doubt that the suit was of the nature cognisable by the Courts of Small Causes. This second appeal does not lie the appeal is therefore rejected. 5. However the learned counsel for the appellant has orally prayed that the certified copies of the judgment of the courts below be directed to be returned to him on supply of typed copies thereof so that he may be able to pursue others legal remedies open to him. The prayer is reasonable. Let the certified copies of the judgment of the courts below be returned to learned counsel for the appellant on his furnishing typed copies thereof. In the event of supply of the copies concerned the certified copies may be returned within 24 hours. 6. A copy of this order may be supplied to the learned counsel for the appellant on payment of usual charges within 24 hours.
