JUDGMENT S.K. Dhaon, J. - The petitioner avers that he is a Sirdar of certain plots. The details of those plots are mentioned in paragraph 1 of the writ petition. He also avers that in an earlier litigation between him and the Gaon Sabha concerned it has been declared that the petitioner is the Sirdar of the aforementioned plots. It is also averred that decree has become final inter-parties. The petitioner avers that on 25th October, 1984 and 1st November, 1984 a proclamation was made in the village that pattas would be executed by the Gaon Sabha with respect to the aforementioned plots on 16th November, 1984. The petitioner apprehends that he may be evicted for only from the aforementioned plots. He, therefore, seeks the protection of this Court under Article 226 of the Constitution. 2. Section 195 of the U.P. Zamindari Abolition and Land Reforms Act confers powers upon the Land management Committee to admit any person as Bhumidhar with non-transferable rights with respect to certain lands which are enumerated in that provision. The provision also enjoins that the Land Management Committee shall act with the previous approval of the Assistant Collector Incharge of the Sub-Division. It will be open to the petitioner to make a representation to the Assistant Collector Incharge of the Sub-Division setting out the relevant facts and pointing out to him that in view of the earlier litigation between the parties the aforementioned plots of which the petitioner claims to be the Sirdar cannot be subjected to any allotment to anybody. If such a representation is made, the Assistant Collector of the Sub-Division shall dispose of the same on merits and in accordance with law. The Assistant Collector of Sub-Division shall do so within one month from the making of the representation by the petitioner before him. Till the Assistant Collector disposes of the representation of the petitioner, the Land Management Committee shall not take any steps to allot the plots in question in favour of any person. We also make it clear that the petitioner shall not be evicted from the plots in dispute, if he is in actual physical possession over the same, except in accordance with law. 3. With these observations the writ petition is dismissed summarily. 4. A copy of this order may be given to the Learned Counsel for the petitioner, today, if possible, on payment of usual charges.
