JUDGMENT S. C. Mathur, J. - This petition is directed against the order dated 451985 passed by the District Magistrate, Lakhimpur Kheri whereby the petitioner's arms licence has been suspended pending proceedings for its cancellation. It has been held by this Court in several decisions that no power vests in the District Magistrate to suspend the licence pending proceedings for cancellation of the arm's licence. Under the circumstances, the impugned order is without jurisdiction and is liable to be quashed. 2. In view of the above, the writ petition is allowed and the Order dated 451985 is hereby quashed. It is clarified that this judgment will not prejudice the proceedings for cancellation of the licence.
