ORDER : 1. Special leave is granted. 2. Head counsel for the parties. Under the facts and circumstances of the case, we are of the opinion that the High Court should not have dismissed the appeal in limine even though there was some default by the appellant in the preparation of paper books. Therefore, we direct that this case be remanded to the appellate court for decision in accordance with law, giving liberty to both the parties to raise such objections as they may have. The costs will be paid in any event by the appellant. 3. Status quo as on today shall be maintained until further orders by the High Court.
