JUDGMENT 1. - This is a second bail application. First application having been rejected on 14-3-85. It is contended that the accused is admitted in the Hospital since 29-1-85. He was operated on 6-3-85 for appendicitis. It was formerly dignose as a viral fever. The sickness still continues. Now it has been detected that he has stones in his stomach. The accused himself is a Homoeopathy Doctor & it appears that there is neither a proper diagnosis nor a proper treatment. Without looking into the merits of the case, purely on medical grounds, 1 deem it proper to enlarge the accused-petitioner on bail. 2. It is, therefore, ordered that accused petitioner Satyendra Kumar be released on bail provided he furnishes a personal bond in the sum of Rs. 10,000/- (Rs. ten thousand) with two sureties in the amount of Rs. 5000/-each to the satisfaction of the trial court with the stipulation to appear in that court as and when called upon to do so.Bail granted. *******
