JUDGMENT P. Dayal, J. - Chhotey Lal has sought by means of this petition under Sections 397/402/482, Cr.P.C. to set aside the order dated November 26, 1984, passed by the Magistrate, for summoning the petitioner and others and rejecting the complaint filed by Tirath which has been registered as Criminal Misc. Case No. 836 of 1984, pending in the Court of Vth Additional Munsif, Bahraich. 2. The opposite party Tirath had filed a complaint under Sections 147, 148, 149, 366, 368, 420, 493, 494, 497 and 498, I.P.C. against the petitioner and 12 others with the allegations that his marriage was solemnised according to Hindu rites with Smt. Shanti Devi. She was enticed away with an intention to sell her and she had taken away with her all the ornaments anti apparels belonging to him regarding which one F.I.R. was lodged under Section 498, I.P.C. Smt. Shanti Devi appeared on the basis of it search warrant and the court recorded her statement when she deposed that she got herself married with Pyare alias Lal Bahadur. 3. It was alleged in the complaint against the petitioner that he knew about the previous marriage of Smt. Shanti Devi and he got her remarried with Pyare alias Lal Bahadur. 4. The first complaint was dismissed by the Magistrate under Section 203, Cr.P.C. The second complaint was filed and the petitioner was shown as an accused in the second complaint and he was summoned by the Magistrate. 5. The Petitioner contends that he could at best be a witness of the second marriage and he could not be an accused and also that the second compliant was not maintainable. 6. The petitioner could either file a revision under Section 397, Cr.P.C. or petition under Section 482, Cr.P.C. while he has moved this petition under both these provisions of law. This petition is not maintainable and is dismissed.
