JUDGMENT 1. - Heard learned counsel for the parties. 2. This is a sound bail application and the bail has been re-moved on the ground that according to the Medical Certificate the age of the boy is above 14 and below 16 years and therefore his case falls under the Children's Act. According to the counsel for the complainant and the Public Prosecutor both the boy is 16 years and 6 months as per School Certificate. it is admitted by the prosecution side that an enquiry about age under the Childrens Act is going on. In this view of the matter I think it would be travesty of justice to detain the boy in Judicial Custody. As it is a case of juvenil delinquency and the forum for holding trial is yet to be decided. He has already been in Jail since March 1984. If he is held to he a child ultimately even the arrest could not be made. 3. Looking to all these circumstances, it is therefore ordered that accused petitioner Ramjilal S/o Bhondu be released on bail provided he furnishes a personal bond in the sum of Rs. 5000/- - with one surety in the like amount to the satisfaction of the trial court with the stipulation to appear in that court as and when called upon to do so during the pendency of the trial against him in this case.Bail granted. *******
