JUDGMENT K.C. Agarwal, J. - This writ petition has been filed by Vijay Pal Singh Negi challenging the order of the Registrar, G.B. Pant University of Agriculture and Technology, district Nainital dated 3-8-82 cancelling his admission to the Undergraduate Programme 1982-83. The cancellation was ordered by the Registrar on account of the petitioner's merit having been wrongly prepared by adding rural weightage to the actual marks secured by him in the written-test for which he was not entitled under the reserved categories. The view of the Registrar was that since the merit of the petitioner had been wrongly inflated, his admission to B. Sc. Agriculture and A. H. was wrong. 2. On the writ petition being filed, this Court passed on ad interim order dated 20-8-82, staying operation of the order cancelling his admission by the aforesaid order dated 3-8-82. 3. Counsel for the petitioner has today produced before us the Provisional Degree Certificate" showing that the petitioner had passed B. Sc. 4. After having gone through the petition and having heard the counsel for the parties, we are of opinion that since the petitioner has passed the examination, it would be a futile exercise to go into the question as to whether the petitioner's admission was wrongly cancelled or not. To take a realistic view it appears to us to direct that the University should declare the result of the petitioner in which he appeared on the basis of the ad interim order dated 20-8-82 passed by this Court. The petitioner shall be deemed to have been validly admitted to the course of the aforesaid examination. Consequent upon what we have said above, the order dated 3-8-82 would be deemed to have been quashed. 5. In the result the writ petition succeeds. The order dated 3-8-82 passed by the Registrar of the University is quashed and the registrar is directed to issue the final result of the petitioner.
