ORDER 1. The petitioner claims himself to he sub-lessee of a Nazul Kothri in Faizabad. The lease in favour of respondent No. 5 having been cancelled, the petitioner is also sought to be dispossessed. The case of the petitioner is that he is being dispossessed through police force while in the case of other occupants proceedings under the U.P. Public Premises Act are being taken. As such he might not be discriminated against and evicted through Police Force without any proceedings against him. 2. On a perused of the affidavit and hearing the learned counsel for the petitioner, we consider it expedient to direct that the petitioner be not evicted from the disputed Kothri except through due process of law. It will be open to the concerned authorities to take proceedings under the U.P. Public Premises Act and evict the petitioner in accordance with law. Subject to the above the writ petition is dismissed. 3. A copy of this order be furnished to the learned counsel for the petitioner on payment of usual charges by tomorrow.
