JUDGMENT Jitendra Prasad, Member - This is a reference made by the Ld. Addl. Commissioner Allahabad vide his recommending order dated 30-11-84 arising out of the order dated 30-11-83 passed by the S. D. O. Etawah in a proceeding initiated on the application of Narauli Vaidpur Parg. Tahsil and Distt. Etawah. 2. An objection against the recommending order has been filed. 3. I have heard the Ld. counsel on either side and perused the record. 4. The learned counsel for the revisionist argued that the lease was granted in favour of the revisionist, that the land in dispute was recorded as Naveen parti and Usar. He while supporting the recommending order of the Ld. Addl. Commissioner relied on the ruling of Honble Board of Revenue reported in 1980 R. J. p. 257. 5. The Ld. D. G. C. (R) in support of his case cited a ruling reported in R. J. 1980 p. 322, that it is a 'Asami patta and will continue to remain as Asami patta.' 6. I have gone through the aforesaid rulings cited on behalf of either party and I am also of opinion that the ruling cited by the revisionist is applicable to the facts and circumstances of the case. The other ruling reported in R. J. 1980 p. 322 and relied upon by the G. S. is not applicable to the facts of this case. The learned Addl. Commissioner in para 5 of his recommending order has rightly observed chat the lease granted to the revisionist was not challenged on the ground of illegality and that he is in possession of the land on the basis of valid lease executed by the L. M. C. Moreover the learned S.D O. without determining the lease has ordered for the ejectment of the revisionist. The land in dispute though recorded as Navin Parti and Usar does not fall in any of the classes mentioned in Section 132 of U. P. Z. A. & L. R. Act and, therefore, the revisionist has become its sirdar. Thus the impugned order is liable to be quashed and reference deserves to be accepted. 7. In view of the above and agreeing with the recommendation of the Ld. Addl. Commissioner I hereby allow the revision and quash the impugned order Dated 30-11-83 passed by the S.D.O. Etawah.
