JUDGMENT S. K. Dhaon, J. - The controversies raised in these petitions are somewhat similar and, therefore, the two petitions can be conveniently disposed of by a common order. 2. During the excise year 197172 the petitioners, it appears, held a licence for dealing in Bhang. It also appears that thereafter the petitioners were granted F. L.5 licence. Some amount was payable by the petitioners towards the licence fee for the year 197677. The respondents raised a demand for the recovery of the said amount. The petitioners set up a case that during the year 197172 they had been supplied Bhang of bad quality which was unfit for human consumption. According to the petitioners, they were entitled to a refund of Rs. 22,310/ on account of this supply of Bhang by the respondents. 3. In Writ Petition No. 1668 of 1983 this Court on 25th March, 1983 passed the following interim order : List after a month in order to enable C.S.C. to obtain instructions. In the meantime the petitioners shall not be arrested in pursuance of the recovery proceedings. The various payments made by them in pursuance of the three separate proceedings shall too be adjusted and the accounts reconciled in the meantime. It is not in dispute that this order continues to operate till date. In Writ Petition No. 1698 of 1983 true copies of representations dated 20th April, 1973, 21st January, 975 and 22nd October. 1982 made by the petitioners to the Excise Comissioner, U.P. for refund/remission of the sum of Rs. 22,310/have been filed as annexures 4 to 6 respectively. It appears that these representations are still pending before the Excise Commissioner. 4. Keeping in view the spirit of the interim order passed by this Court in Writ Petition No. 1668 of 1983, we consider it expedient that the Excise Commissioner, U.P. should dispose of the aforementioned representations made by the petitioners within a specified time. We accordingly direct the Excise Commissioner to dispose of the said representations within a period of two months from the date of presentation of the certified copy of the order of this Court, by the petitioners. 5.

We have considered the matter carefully and we are of the view that till the Excise Commissioner disposes of the representations of the petitioners, the interim orders passed by this Court in Writ Petition Nos.1668 of 1983 and 1698 of 1983 dated 25.3.1983 and 17.1.1986 respectively shall continue to operate. These orders will come to an automatic end the moment the Commissioner disposes of the representations. 6. With these observations both the petitions are disposed of finally.
