JUDGMENT 1. Hears learned counsel for the parties and perused the case diary produced by the non-petitioner. On going through the case diary it is felt that this case is of eminence importance to the general public which is said to have been cheated in this case. A document on the case diary shows that the Dangal Samiti which conducted the wrestling tournament has its president Mr. Shantnu Kumar who is D.I.G., Kota. Also from the papers, it is revealed that some parts of the proceeds were given to the Police Welfare Fund. When the police of Kota is actively interested in this case, it does not appear to be proper that the investigation in this case should be done by it. This case should be investigated by an independent agency and, therefore it is directed that the C.B.I. should take it up for investigation, On the bail application it is ordered that the petitioner shall not be arrested until the C.B.I. has made some progress in its investigation and taken permission of this court. It is also directed that the petitioner shall not leave India without the permission of the court and shall also appear for investigation before the C.B.I. as and when directed by this Court. The petitioner shall give an undertaking in accordance with the above order. The State Government is directed to take necessary steps for handing over the investigation to the G.B.I. 2. Put up after four weeks. 3. Copy of this order be sent to the State Government and to the C.B.I.Interim bail granted. *******
