H. C. Goel ( 1 ) THIS is a petition under sections 8 and 20 of the Arbitration Act with the prayer that the Chairman-cum-Managing Director of the respondent No. 1 may appoint an arbitrator and the matters in dispute that have arisen between the parties out of the contract be referred to the arbitrator so appointed by him. The parties counsel state that the Chairman-cum-Managing Director of the respondent No. 1 has already appointed Mr. A. V. Vaidya, Chief Project Manager (DDA Works), N. B. C. C. Ltd. , Sector-14, Rohini, New Delhi as an arbitrator to decide the matters in dispute that have arisen between the parties. They further say that both the parties may file their claims and counter claims before him and the petition may be disposed of accordingly. In view of this statement of the counsel for the parties, the petition is dismissed. The parties shall file claims and counter-claims before the said arbitrator who shall give his award in accordance with law. The petition stands disposed of.
