A. B. Saharya ( 1 ) WRITTEN statement to the main petition under Section 20 of the Arbitration Act has been filed. It is not denied that there is existing a valid arbitration agreement between the parties. The arbitration agreement is contained in clause 25 of the contract. ( 2 ) THE defendants have not pointed out any provision in the contract for excluding reference of any of the claims raised by the petitioner. ( 3 ) ACCORDINGLY, the arbitration agreement between the parties is ordered to be filed into court and a reference is hereby ordered to be made of all claims enumerated in the petition to sole arbitration of a person to be appointed by the Chief Engineer, Flood Control and Drainage Divn. , Delhi Administration, Delhi, in accordance with clause 25 of the contract, within two months from today. Accordingly, Suit No. 271a/86 is disposed of. Parties are left to bear their own costs. I. A. 2273/86 and I. A. 4934/86. Heard. Interim orders made on 4th of February 1986 and 3rd of Septemer 86 will operate till arbitrator makes his award. Accordingly, both these interim applications are also disposed of.
