ORDER Admit and connect with other writ petition of Similar nature under which vires of U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 has been questioned. 2. We have heard the learned counsel for the parties it has been contended on behalf of the State that the applicant should not be released on bail in view of the averments made in para 8. In this paragraph he has mentioned about 8 cases registered under various sections of the Indian Penal Code. It has been further brought to our notice that the applicant was detained under the National Security Act in 1981, but the same was revoked by the State Government itself. 3. Learned counsel invited our attention to Annexure CA 4. Most of the offences relate to the year 1979. The learned counsel invited our attention with respect to offences mentioned from serial No. 18 onwards. It is admitted before us that most of the reports lodged against the petitioner were initiated by Rudra Prasad who was the Manager during the lifetime of Raja Bajrang Bahadur Singh. There is categorical averment in para 5 with respect to the motive prevailing in the mind of Rudra Prasad, the erstwhile Manager of the Estate, there appears to be some substance in the contention raised in para 5 and on account of family dispute a various magnitude is being created to scandalise the petitioner who is the virtual owner of the property, being the sole male lineal descendant of late Raja Bajrang Bahadur Singh. 4. On giving our anxious consideration to the entire facts and circumstances, we are not inclined to refuse bail to the petitioner. We therefore order that the petitioner will be released on bail on his furnishing adequate sureties and a personal bond of like amount to the satisfaction of Special Judge, concerned. 5. Copy of this order may be issued within 48 hours.
