Brij Kishore v. Joint Director of Consolidation, District

1986-05-22

B.L.YADAV

body1986
JUDGMENT B.L. Yadav, J. - Having heard the learned counsel for the petitioner, I do not find any merits in this writ petition. It has been urged on behalf of the petitioner that the contesting respondent has been given a chak in between the chaks of the petitioner. But from memo of revision filed as Aunexure 2 to the petition it does not appear that any such ground was specifically taken. Further the consolidation authorities have assigned good reasons for not accepting the claim of the petitioner. Under Section 19 of the U.P. Consolidation of Holdings Act there is no provision laying down that any other tenure holder cannot be given a chak in between the chaks of another person. This can be done provided the petitioner has otherwise been compensated by allotting a suitable chak. 2. No other point was pressed before me. The petition is devoid of merits and it is accordingly dismissed in limine.
