ORDER : We are of the view that having regard to the fact set up in the affidavit it would be fair to direct by way of an interim order that the goods imported by the petitioners in the present case should be allowed to be cleared on payment of duty assessed on the basis of C.I.F. value of the goods as appearing in the invoice. The petitioners will execute a personal bond within 2 days in favour of the Collector of Customs for the amount of customs duty calculated on the basis of the C.I.F. value and the customs duty as per the Order of the Assistant Collector of Customs dated 24.9.1986. On the execution of such bond and payment of such customs duty, the goods shall be allowed to be cleared. Our earlier orders will stand with the modification.
