ORDER : 1. We wonder whether in view of this Court's order Dated July 31, 1986, the appointment of Shri P.P. Caprihan, Chief Secretary to the Government of Haryana to be the Enquiry officer, the petition filed under Article 226 of the constitution questioning his appointment can at all survive. This the High Court will consider. 2. We direct the Enquiry Officer to proceed with the enquiry against Ram Gopal and Hardwari Lal, as expeditiously as possible. 3. In the meantime, we stay all the proceedings before the High Court in Writ Petition Nos. 1514 and 1273 of 1986. We also vacate the order granted by the High Court restraining the Enquiry Officer from passing the final order, reserving liberty to the petitioner, Ram Gopal, to challenge the same on all such grounds as are available, if so advised.
