ORDER 1. Heard the learned counsel for the petitioner. 2. This petition has been moved with the prayer that proceedings for civil contempt be initiated against the respondent for having disobeyed the interim order dated 2-1-1986 passed by the Public Services Tribunal. 3. It so appears that the petitioner Ashok, Kumar Verma moved petition No. 500/F4/ 1985 before the Services Tribunal for various reliefs. The Tribunal by means of an interim order passed on 2nd of January, 1986 directed Umesh Kumar Mittal, A. D. M. (Finance), Ghazipur to pay the petitioner's salary for the month of December, and thereafter to pay the monthly salary on subsequent months as and when they fall due, till the decision of the application for interim relief. The petitioner moved an application before the A. D. M. (Finance), Ghazipur, along with a copy of the order passed by the Services Tribunal, praying that his salary be paid since the date when he was relieved from Gyanpur. He made a further prayer for permission to join his services. It is alleged that the opposite party has neither paid the petitioner's salary since the day he was relieved from Gyanpur nor has permitted him to join his duty. The interim order dated 2-1-86 passed by the Tribunal does not direct the opposite party to pay the salary since the date when the petitioner was relieved from Gyanpur. The order does not give any direction for permission to the petitioner to join his duty. The order on the other hand gives full liberty to the opposite party to either take any work from the petitioner or not to take any work from him. The opposite party has also been given option for not giving any appointment to him. The only direction is to pay the salary for the month of December and continue to pay the salary for the subsequent months till the decision of the application for interim relief. The prayer made by the petitioner has rightly not been accepted by the opposite party and in doing so he cannot be held guilty of disobeying the directions of the Tribunal. It is still open to the petitioner to move the opposite party for payment of his salary for the month of December and subsequent months till the decision of the interim relief application.

I trust, the opposite party would suo motu comply with the direction of the Tribunal, and pay the salary for the month of December and onwards if it has not been paid so for. 4. With these observations the prayer for initiating proceedings for civil contempt is rejected.
