JUDGMENT 1. - Heard counsel for the parties. 2. Learned counsel for the petitioners does not challenge conviction of the petitioners. He however, submitted that the sentence awarded is severe. 3. These facts and circumstances may be considered that there were cross cases and one of the accused Bhag Singh has already been given the benefit of probation. 4. Having regard to the circumstances of the case, in my opinion ends of justice would be served in case substantive sentence of the petitioners on each counts is reduced to the period of custody and sentence of fine is suitably awarded. 5. Accordingly the revision is partly allowed. The convictions of the petitioner are maintained. Their substantive sentences are, however, reduced to the period of their custody on each count. Bakhtawar Singh is sentenced to the fine of Rs. 1000/- u/s 326 IPC and in default of payment of fine he will undergo two months' rigorous imprisonment. Fine if paid, of the sum of Rs. 750/- shall be paid by the way of compensation to the injured Gurbachan Singh. 6. Sentence of fine of Rs. 500/- is imposed on the petitioner Thana Singh, for the offence u/s 326/34 IPC and in default of payment of fine, he will undergo two months' rigorous imprisonment. Fine if paid to the Rs. 400/- shall be paid to the injured Gurbanchan Singh.Revision partly allowed. *******
