JUDGMENT 1. - I am informed by the learned counsel for the petitioner that consequent upon filing of this petition it was brought to the notice of the Additional Sessions Judge that he has no jurisdiction to try an offender under the provisions of Essential Commodities act since under E.C. Act the jurisdiction vests in the particular Sessions Judge as Special Judge Contemplated by the notification issued from time to time in exercise of the powers conferred by sub-section of section 12A of Essential Commodities Act 1955, as substituted by section 11 of essential Commodities (Special Provision) Act 1981 and for the purpose of Dholpur District powers of Additional Sessions Judge Dholpur have come to an end with effect from 7.4.83 vide notification published in Rajasthan Gazette Part IV (Ga) II dated 1.6.84. As such the trial now has rightly been transferred to the competent Court. It may e made clear when the matter of jurisdiction arises the entire proceedings before the court having no jurisdiction have to be quashed for want of jurisdiction and when the case goes to the competent court denovo proceedings has to be taken, As such the order of the Additional Sessions Judge dated 22.5.1986 and the consequent record of plea has to be quashed. In case the learned Sessions Judge has already taken denovo proceedings there is no necessity of my passing any order. But in case he has taken note of the earlier proceedings, it is hereby directed that any proceedings taken prior to taking cognizance by Sessions judge, Dholpur as Special Judge under Essential Commodities Act, shall be deemed to have been quashed. 2. With the above observations this revision petition is disposed of 3. A copy of this order may be sent to the Session Judge, Dholpur forthwith.Revision allowed. *******
