ORDER : 1. Special leave granted. 2. We are of the view that there was no justification to quash a part of the preamble of the notification by which the Commission was constituted. Accordingly, that part of the direction given in the impugned judgment will stand vacated. 3. The allegation of bias against the Chairman of the Commission was not examined by the High Court as it held: "On a reading of the counter, we are uncertain as to whether he intends to continue as Chairman or he has resigned from the inquiry. This fact is made clear by his counsel to declare that the Chairman has resigned from the Commission and is not there to inquire the issues. In view of this unequivocal declaration in the Court, the issue of bias need not be considered." 4. This Court had issued notice to the Chairman and he is represented by counsel. His counsel tells us that there is really no resignation as indicated in the order of the High Court and he would he prepared to continue unless he is relieved from the responsibility by the State Government. In view of this position, it would become necessary. for the High, Court to consider the allegation of bias. We accordingly set aside the impugned decision of the High Court and remit the matter back-to it for a fresh disposal on the question of bias. The Writ Petition may be disposed of early, preferably within two months from now. There will be no order as to costs.
