JUDGMENT 1. - Heard learned counsel for the parties. 2. Learned counsel for the petitioners pointed out that in S.B. Cr.Misc. Bail Appl. No. 764/86 Shokat Ali v. The State pre-arrest bail was granted by this court on 21.3.1986. In this case a forged certificate had been produced by the accused person for obtaining employment as conductor, it is therefore, prayed that the petitioners in any case stand on some footing in as much as they only wanted to seek employment and for that purpose they produced this certificate to get admission in training which may have entitled them to get some employment. It is also given out that one of the petitioner is 18 years of age and other two accused petitioners are 23 years old and they belong to lower middle class family. 3. Learned P.P. has opposed the application on the ground that in any case the petitioner are involved in production of forged documents and therefore, deserve no sympathy of the court. 4. Keeping in view the young age of the petitioners and the circumstances in which they live I deem it just and proper to grant them bail. 5. The SHO/Arresting Officer/I.B., Police Station, Nayapura, Distt. Kota, is, therefore, directed that in the event of arrest of the petitioners Dinesh Kumar, Jamnalal and Rajendra Kumar, in FIR No. 71/86 they be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 5,000/- with one surety in the like amount to his satisfaction on the following conditions:- 1. That the petitioners shall make themselves available for interrogation by a police officer as and when required; 2. That the petitioners shall not, directly, make any inducement, threat of promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer, 3. That the petitioners shall not leave India, without he previous permission of the court. Notice was also given to call the IO in the this case. Shri Rafiq Ahmed, IO is present in court today. On enquiry as to why no action has been taken against agency which is supplying these certificates to students he has stated that since the diary was with P.P. for quite sometime, action against these persons who issued the certificates could not be taken earlier which they proposed to take as soon as the diary is received back by them.Bail granted. *******
