JUDGMENT 1. - Heard learned counsel for the accused-petitioners and the learned Public Prosecutor for the State, and also perused the documents on the record. He is said to be 70 years. The eye witnesses, Mangu has not assigned any role regarding causing any injury by Shemala to deceased Malaram. Sultan in his statement has clearly stated that Gopal given lathi blow to deceased on his head. 2. In the facts and circumstances of the case and after hearing the arguments advanced by both the sides, I am inclined to grant bail u/s 439 Cr. PC to the accused-petitioners Bhemala. 3. It is, therefore, ordered that accused-petitioner Bhemala S/o Nathu be released on bail provided he furnishes a personal bond in the sum of Rs. 5000/- (Rupees five thousand) with one surety in the like amount to the satisfaction of the trial court with the stipulation to appear decided on 29-10-86. in that court as and when called upon to do so during the pendency of the trial against him in this case. 4. The bail application of Gopal is rejected.Bail granted. *******
