Hanuman Singh v. State of Rajasthan

M.C.JAIN

body1986
M.C. JAIN, J.—Learned counsel for the petitioners have produced photostat copies of some documents running into 48 pages. 2. Heard learned counsel for the parties. 3. For about an hour after references from the case-diary I do not want to express any opinion on the merits of the case, but from the correspondence and other material which has come on record. I am inclined to enlarge the applicant on bail. It is really very sad that the deceased Anita was found in hanging condition on 24th June, 1986 She was married only on 28th May, 86, just after one month and four days. The dead-body remained lying for two days and it was cremated only on 30-6-1986 when the nearer relatives of the deceased had come. The petitioners had produced a document in the form of the no-objection by the father of the deceased who was informant in this case. Having expressed that he had no objection, the report was filed by him on 8th July 1986 on which the case u/s 306 and 498-A IPC was registered. My attention was particularly invited to the letter of the deceased dated 20th June, 1986 in which the deceased has expressed that everyone keeps all care of her. As already stated, the matter has to be received in its entirely without expressing any opinion, so I find this case a fit one for the exercise of power under section 438 Cr.P.C. 4. Accordingly, the application for bail is allowed and it is ordered that in the event of arrest of the applicants Hanuman Singh and Smt. Amar Kanwar, they be released on bail provided each one of them furnishes a personal bond in the sum of Rs 4000/- with one surety in the like amount to the satisfaction of Investigating Officer, Police Station, Churu in FIR No. 104/86. 5. It is further directed that the applicants shall make themselves available for the purpose of interrogation as and when required by the Police.
