JUDGMENT R. Singh, J. - Heard both the parties. I have seen the F.I.R. and the medical report. From these documents it does not appear that a case under Section 307 I.P.C. is prima facie made out so at this stage it is directed that the petitioner shall appear before the Magistrate, who will consider the bail application treating the case as under Section 323/ 324 I.P.C. Any observation made in this order will not affect the trial of the case. The accused may appear before Magistrate within ten days. The accused will not be arrested within ten days. The application is disposed of accordingly.
