JUDGMENT K.J. Shetty C.J. and R.M. Sahai, J. - The petitioner seeks admission to the post graduate course M.D. in Forensic Medicine on the ground that he is an internal candidate and his claim has been unreasonably overlooked by the respondent University. 2. The case of the respondent is that the petitioner cannot be treated as an internal candidate he having passed the MBBS examination more than three years earlier to the admission sought for. The only question, therefore, to be considered is whether the petitioner could be considered as an internal candidate. In this connection para 4 of the Guide of the University is quoted below : "An Internal candidate is one who has passed the qualifying examining from this University not earlier than 3 years from the date of admission to the course applied for, after undergoing a regular course of study for a period of at least one academic year in this University or its maintained Institutions." 3. The applications for admission were considered by the University in July, 1986. The petitioner passed his qualifying examination in February, 1983. The actual admission to the Post Graduate Course has taken place on 20th September, 1986. From these dates it will be clear that the petitioner has passed the qualifying examination more than three years from the date of admission to the course applied for. The contention of the petitioner, therefore, that he ought to be treated as an internal candidate does not merit any serious consideration. 4. We also do not find any substance in the next contention urged by the petitioner regarding discrimination. From annexure to the counter affidavit filed by the University which gives details of the candidates selected for Post Graduate Course, it is apparent that no candidate has been selected who passed the qualifying examination earlier to February, 1983. 5. The writ petition, therefore, fails and it dismissed. 6. Learned counsel for the petitioner on his request was permitted to delete the prayer in respect of quashing the list since the selected candidates were not made parties in the writ petition.
