ORDER : 1. This appeal by special leave is filed against the refusal of the High Court to grant stay order pending disposal of the Write Petition No, 1874 of 1986 on the file of the High Court of Karanataka staying the recovery of additional tax levied against the appellant under the provisions of Section 8 of the Karnataka Motor Vehicles Taxation Act, 1957. In view of our decision in M. Narasimhaiah v. The Deputy Commissioner for Transport, Bangalore Division, Infantry Road, Bangalore & Anr., Civil Appeal No. 3031 of 1987 decided today we are of the view that the stay order as prayed for by the appellant should be granted. The respondents are directed not to take any steps to recover the additional tax from the appellant pending disposal of the said writ petition. The High Court is requested to dispose of the Writ Petition No. 18474 of 1986 out of which this appeal arises keeping in view the observations made by this Court in M. Narasimhaiah's case (supra), The appeal is accordingly allowed. No costs.
