N. Viswanath v. State of Karnataka

1987-11-24

E.S.VENKATARAMIAH, K.N.SINGH

body1987
ORDER : These appeals by special leave are filed against the decision of the High Court of Karnataka in Noorullha Khan v. State of Karnataka, Writ Petition No. 8302 of 1980 and connected cases decided on 26.6.1985. The appellants were not parties to the said writ petition. They have, however, filed these appeals with the leave of the court as a matter of abundant caution against the said judgment on the ground that the decision therein would affect them also since they also happen to be motor operators liable to pay tax under the Karnataka Motor Vehicles Taxation Act, 1957. In M. Narasimhaiah v. The Deputy Commissioner for Transport, Bangalore Division, Infantry Road, Bangalore & Anr., Civil Appeal No. 3031 of 1987 we have pronounced judgment today overruling the decision in Noorullha Khan's case. There is no need to pass any further orders in these appeals. These appeals are, therefore, disposed of. No costs.
