JUDGMENT R.A. Misra, J. - Admit. Issue notices. learned A.G.A. has taken notice and the matter may be disposed forthwith. 2. The only point raised is, that keeping in view the facts and circumstances of the case and the sentence awarded the appellants should be released on probation of good conduct instead of requiring them to serve out sentence at once. 3. The revisionists have been sentenced to undergo R.I. for a period of 8 months under Section 325/34 I.P.C. Six months under Section 323/34 I.P.C. and three months under Section 506 I.P.C. with direction that all the sentences of each accused shall run concurrently. The courts below have not given good reasons for not having extended the benefit of Probation Act to the Revisionists. They have actually not considered this point to which they were required to consider according to law. No useful purpose is likely to be observed by requiring the revisionists to serve out the sentence and remain in jail for the aforesaid short period. On the other hand their association with hardened criminals in Jail is likely to have adverse effect on their future career. I fully agree with the learned counsel for the revisionist that this is a fit case where the revisionists should be released on probation of good conduct instead of requiring them to serve out the sentence. The revision is, therefore, allowed only on the point of sentence. The conviction and sentence passed against the revisionists is confirmed but instead of requiring them to serve out the sentence at once. I direct the revisionist to be released on probation of good conduct for a period of one year each subject to each of them executing personal bonds and two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate, Faizabad, to appear and serve out the sentence which called upon during the aforesaid period and in the mean time to keep the peace and be of good behaviour. They are granted forty five days time to furnish bonds and sureties. In default they shall be taken into custody to serve out the sentence. 4. Let a copy of this order be issued to learned counsel for revisionists today on payment of usual charges for being placed before the Court below for compliance.
