( 1 ) THIS is an application under Section 10 of the Contempt of courts Act, 1971. The main grievance of the petitioner is that an order, which was passed by the Deputy Registrar, Co-operative Societies, under Section 64 of the M. P. Co-operative Societies Act, 1960 (hereinafter referred to as "the Act")in a dispute raised by the petitioner, has not been complied with so far. The petitioner has, therefore, prayed that action under the Contempt of Courts Act be, therefore, taken against the respondents. ( 2 ) HAYING heard learned counsel for the petitioner, we have come to the conclusion that this application deserved to be dismissed. An order passed by the Deputy Registrar under Section 64 of the Act, if not carried out, can be executed in the same manner as a decree of the Civil Court, by virtue of Section 85 of the Act. Merely on the ground that the order passed, by the Deputy Registrar has not been set aside by the appellate authorities and by this Court in a petition under Article 226/227 of the Constitution. Action under the Contempt of Courts Act cannot be taken. This petition filed by the petitioner is misconceived. ( 3 ) THE petition is, therefore, dismissed. No order as to costs. .
