ORDER : 1. Special leave granted. 2. After hearing counsel appearing for both the sides at considerable length we are of the opinion that on the facts and circumstances brought out by the materials on record it cannot be said in this case that the requirement of Section 9(2) (ii) of the Punjab security of Land Tenures Act, namely, that the tenant should have failed to pay rent regularly without sufficient cause has been established by the landlord. In the light of the above conclusion reached by us we set aside the orders passed by the High Court, The Financial Commissioner and the Commissioner, and restore the Order dated March 27, 1984 passed by the Collector. The appeal is accordingly allowed. The parties are directed to bear their respective costs.
