ORDER 6/9-7-87. This writ application is directed against a notification bearing S.O. No. 1744 dated 27-12-1975 as contained in Annexure-1 to the writ application whereby and whereunder the fee for registration or workman under the provisions of Bihar Shops and Establishment Act, was increased, This notification has been declared ultravires by a Division bench of this Court reported in 1980 B.L.J.R. Page 349. In view of the fact that the notification in question itself has been quashed by a Division bench decision of this court in the aforementioned decision, this petitioner must succeed. In tile result, this writ application is allowed with cost which is quantified at Rs. 1000/-, Application allowed.
