JUDGMENT 1. - The case is one for offence under sections 379 and 447 IPC in respect of removal of the Crop. It is a dispute between the parties i.e. complainant and the accused regarding the possession of the field. Case of the accused is that he is a bonafide purchaser of value by registered deed dated 27-8-1974 and this sale deed it is alleged has been accepted by complainant Smt. Roopli. Subsequently due to misleading by certain persons, she wants to fall back or the transaction. In these circumstances I grant indulgence to the accused petitioner. 2. It is, therefore, directed that accused petitioner Heera Ram S/o Shri Ishwar Ram be released on bail provided he executes a personal bond in the sum of Rs. 5000/- (Rupees five thousand only) with one surety in the amount of Rs. 5000/- to the satisfaction of the trial court with the stipulation to appear in that court as and when called upon to do so during the pendency of the trial against him in this case. 3. Since the past conduct of the accused had been that he had been leaving country without obtaining permission of the Court. It will be desirable that the Court shall ask him to deposit the pass port which shall be returned to him after trial is over. It being a case of 1975 the trial may be expedidious and should be completed within three months from the date of receipt of this order.Bail granted. *******
