ORDER : 1. In the matter of Swadeshi Polytex Ltd. in Civil Appeal Nos. 577- 79/87 on 6th March, 1987 we had passed an order in respect of the Annual General Meeting. We appointed Shri Jaswant Singh, a former Judge of this Court as a Chairman of the said Annual General Meeting. We had directed that the meeting will be held under the chairmanship of Shri Jaswant Singh notwithstanding any order made by any court or that may be made by any Court subsequently, stopping the meeting or appointing anybody else as the Chairman. It appears to us that in view of this the meeting to be held pursuant to the order of this Court on 9th March, 1987 should be given effect to irrespective of any order, injunction or directions contained in the matter of any Court including the order passed in Writ Petition No. of 1987 (Mahesh Jashnani v. M/s. Swadeshi Cotton Mills Co. Ltd., Kanpur & Ors.) on 7th March, 1987 by Hon'ble Mr. Justice D.N. Jha and Hon'ble Mr. Justice Brijesh Kumar by Lucknow Bench of Allahabad High Court. This matter is taken on Board and the order is passed accordingly. 2. The votes cast in the meeting will be separately recorded and their rights will be decided by the Chairman in the first instance, subject to any judicial adjudication, if any. The operative portion of the direction of the Allahabad High Court is vacated. 3. The special leave petition is disposed of accordingly.
