(1) SPECIAL leave granted. (2) BY consent of parties we appoint Mr D. R. Khanna, a retired Judge of the High court of Delhi as arbitrator to arbitrate on the dispute between the parties involved in the Civil Suit No. 349/83 on the file of Sub-Judge, First Class, Bhiwani and any other dispute which may beraised by either of the parties arising out of the same transaction. We fix Rs. 7,500.00 as the total fee payable to the arbitrator. At the first instance, the amount of Rs. 7,500.00 shall be deposited by the appellant, Indian Oil Corporation Limited subject to thei order of the arbitrator with regard to the party who should bear it ultimately depending on the result of the case. The arbitrator is requested to dispose of the case within eight weeks from the date on which he receives a copy of this Order. The award may be filed in this court. Pending arbitration the suit before the Civil court shall stand stayed. (3) THE appeal is accordingly disposed of.
