JUDGMENT : 1. Leave granted. 2. We have heard learned Additional Solicitor General for the Union of India as also for the Government of Andhra Pradesh in the two separate appeals. 3. So far as the interpretation of the Rules is concerned, we are inclined to agree with his submission that the deemed suspension under Rule 2(3) does not get automatically revoked. On the other hand Rule 4(7) indicates that even in the case of deemed suspension an order of the appropriate authority is necessary to revoke suspension. So far as the facts of the case are concerned, we are of the view that this is a fit case where the suspension should have been revoked at the earliest point of time. While we reiterate that an order of the appropriate authority revoking the suspension is necessary, in the facts of the case we do not want to interfere with the direction of the Tribunal that suspension stands revoked. 4. We have disposed of these matters without notice to the respondent No. I as no part of our order is adverse to him. No costs.
